Heliograph for iOS
The short version. Heliograph is a free app that shows public space-weather data from NOAA and NASA. It's provided as-is, for general information and enjoyment — not for safety-critical, navigational, or operational decisions. We collect no personal data. Your statutory rights under the Australian Consumer Law are not affected by anything below.
Heliograph (the "App") is published by Aphelion Engineering Pty Ltd ("we", "us", "our"). These Terms of Use govern your use of the App on iPhone, Apple TV, and Apple Watch. By downloading or using the App, you agree to these terms.
The App is also subject to Apple's Licensed Application End User License Agreement (standard EULA). Where these Terms and Apple's standard EULA both apply, these Terms supplement it; if they genuinely conflict, the terms more protective of your statutory rights apply.
We grant you a personal, non-exclusive, non-transferable, revocable licence to use the App on Apple devices you own or control, in accordance with these terms and Apple's App Store terms. You may not sell, redistribute, reverse-engineer, or attempt to extract the source code of the App except to the extent that restriction is prohibited by law.
Please use the App lawfully and reasonably. Don't use it to break the law, interfere with the public data sources it relies on (for example, by attempting to overload NOAA or NASA endpoints through the App), or misrepresent the App as an official NOAA or NASA product.
Heliograph presents space-weather data and forecasts from the NOAA Space Weather Prediction Center and imagery from NASA as faithfully as it can, with an honest "as of" timestamp on each value. However:
The App displays public-domain data and imagery from NOAA and NASA. Those agencies do not endorse the App, and Heliograph is not affiliated with, sponsored by, or endorsed by NOAA, NASA, or Apple. All product names and trademarks belong to their respective owners.
The App is provided "as is" and "as available", without warranties of any kind except those that cannot be excluded by law. To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential loss arising from your use of, or reliance on, the App or the data it displays.
Australian Consumer Law. Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law or other applicable law that cannot lawfully be excluded. Where our liability for breach of such a guarantee can be limited, it is limited to re-supplying the App or paying the cost of re-supply.
These terms are between you and Aphelion Engineering Pty Ltd, not Apple. Aphelion Engineering — not Apple — is solely responsible for the App and its content, and for providing any maintenance and support for it; Apple has no obligation to furnish maintenance or support services. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Any App questions, support, or claims (including product-liability and consumer-protection claims) should be directed to us at the address below, consistent with Apple's standard EULA.
We may update the App and these terms from time to time. If we make material changes to these terms, we'll update this page and revise the effective date above. Continued use of the App after a change means you accept the updated terms.
These terms are governed by the laws of Australia, without limiting any non-excludable rights you have under the consumer law of your own country or jurisdiction.
